Acceptance of Terms of Use
These Terms of Use govern your use of the DVDWishes.com Web site. By using, visiting, or browsing the DVDWishes.com Web site, you accept and agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you should not use the DVDWishes.com Web site.

Changes to Terms of Use
DVDWishes reserves the right, from time to time, with or without notice to you, to change these Terms of Use at our sole discretion. The most current version of these Terms of Use can be reviewed by clicking on the "Terms of Use" link located at the bottom of the pages of the DVDWishes.com Web site. The most current version of the Terms of Use will supercede all previous versions. Your use of the DVDWishes.com Web site after changes are made means that you agree to be bound by such changes.

Privacy
Any information submitted to DVDWishes.com is subject to our Privacy Policy.

Limitations on Use
You must be 18 years of age or older and certify your age via electronic affidavit at the time of registration to use the DVDWishes service. The material distributed via DVDWishes is for personal use only and may not be used for commercial distribution. You may not download, modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from, the DVDWishes.com Web site without our express written consent and the consent of the content's rights holder. Any unauthorized use of the DVDWishes.com Web site or its contents will result in the termination of your account.

Our products and services are directed solely to individuals residing in the United States. We make no representation that materials provided in DVDWishes are appropriate or available for use in other locations. Those who choose to access any DVDWishes Products from other locations do so on their own initiative and at their own risk, and are responsible for compliance with local laws, if and to the extent applicable. We reserve the right to limit the availability of DVDWishes Products and/or the provision of any service or product described therein to any person, geographic area, or jurisdiction we so desire, at any time and in our sole discretion, and to limit the quantities of any such service or product that we provide.

Free Trial Offer
Free trials are only available to first time customers of the DVDWishes service and cannot be combined with any other offer. The free trial is only available on the two disk "Light" plan. You must have Internet access, a valid credit card, and be at least 18 years of age to redeem a free trial offer. Only one free trial may be redeemed per household. Upon registering for your free trial, your credit card will be authorized for one month of service ($17.95). No charges, however, will be made against the card unless you do not cancel prior to the end of your free trial period and return all outstanding DVDs. Your free trial entitles you, during the term of your free trial, to the same service provided to our paying subscribers. We will begin billing your credit card for monthly subscription fees for the DVDWishes Light Program (currently $17.95) and any applicable sales tax at the end of your free trial period unless you cancel prior to the end of your free trial. YOU MUST CANCEL YOUR SUBSCRIPTION PRIOR TO THE END OF YOUR FREE TRIAL OFFER TO AVOID CHARGES TO YOUR CREDIT CARD. We will continue to bill your credit card on a monthly basis for the DVDWishes Light Program until you cancel. The DVDWishes.com provides month-to-month subscriptions that allow subscribers to rent as many DVDs as they want in the month, with anywhere from two to six titles out at a time, with no late fees or due dates. Your subscription is cancelable at anytime but no refunds will be made for unused portions of the month.

You may upgrade to a higher program offering more DVDs out at a time through the customer account section of the site. You will be charged the difference between your current program and the higher price of the upgraded program for the first month. Subsequent months will be billed at the rate of the higher program. Additional DVD(s) provided for in the higher program will be shipped immediately.

Billing
The company name on your credit card billing statement will be INDEPENDENT MEDIA GROUP.

As a member of DVDWishes, you agree that we are permitted to charge your credit card a monthly subscription fee, any applicable sales tax and any other charges you may incur in connection with your use of DVDWishes. The subscription fee will be billed at the beginning of your subscription and on each monthly renewal thereafter unless and until you cancel. We will automatically charge your credit card each month on the calendar day corresponding to the commencement of your membership. In the event your membership began on a day not contained in a given month, we will bill your credit card on the last day of such month. For example, if you became a member on January 31st, your card would be billed on February 28th. Your membership will automatically renew for successive monthly subscriptions, without prior notice to you, unless and until you cancel your membership or we terminate it. You must cancel your membership and return any outstanding DVDs before it renews in order to avoid billing of subscription fees to your credit card. All fees and charges are nonrefundable. We may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by email.

Delivery and Return of Rented Disks
We use the U.S. Postal Service, first-class postage prepaid, for delivery and return of the DVDs you have selected to rent. Actual delivery times may vary for you depending on your delivery address, when you place your order and and the ability of USPS to meet its normal operational milestones. DVDWishes will send you an e-mail each time a DVD has been shipped and received.

Cancellation
As noted above, you may cancel your subscription to DVDWishes at anytime. We do not provide refunds or credits for any partial monthly subscription periods. Upon cancellation, you will be given seven (7) days to return any outstanding rentals. Failure to return such rentals will result in your credit card being billed for such items at the normal member rate.

Disclaimers of Warranties and Limitations on Liability
The DVDWishes.com Web site and its contents are provided "as is" and we make no representations or warranties of any kind with respect to the DVDWishes.com Web site or its contents. We assume no liability or responsibility for any errors or omissions in the content of the DVDWishes.com Web site, any failures, delays, or interruptions in the shipment of DVDs, delivery of any content contained on the DVDWishes.com Web site, any losses or damages arising from the use of the content provided on the DVDWishes.com Web site, or any conduct by users of the DVDWishes.com web site. We reserve the right to ship DVDs at our sole discretion.
In no event shall DVDWishes.com, its shareholders, directors, officers, or employees be liable (jointly or severally) to you for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, as a result of membership or actions by this site.

Intellectual Property
All content included on the DVDWishes.com Web site, including text, graphics, logos, designs, photographs, button icons, images, audio/video clips, digital downloads, data compilations, and software, is the property of DVDWishes, Inc. or its suppliers and is protected by United States and international copyright laws. Photographs of DVDWishes models, whether appearing on the DVDWishes site or not, are the exclusive content of DVDWishes and may not be utilized in any matter without the express written consent of DVDWishes. The compilation of all content on this site is the exclusive property of DVDWishes, Inc. and protected by U.S. and international copyright laws. They should not be reproduced or used without express written permission from DVDWishes.com.

Outside Contributions
DVDWishes distributes adult oriented DVD entertainment. In addition, the DVDWishes.com Web site allows you and other third parties to post reviews or comments concerning the entertainment distributed by us. Any opinions or statement that constitutes part of the content expressed or made available by third parties on the DVDWishes.com Web site are those of the respective authors or producers and not of DVDWishes.com or Independent Media Group, LLC or its shareholders, directors, officers, or employees. Under no circumstances shall DVDWishes.com or Independent Media Group, LLC or its shareholders, directors, officers, directors, or employees be held liable for any loss or damage caused by your reliance on information obtained through the DVDWishes.com Web site. It is your responsibility to evaluate the information, opinion, advice, or other content available through the DVDWishes.com Web site. We reserve the right to remove or edit such content at anytime without notice.

By sending or transmitting to us creative suggestions, ideas, notes, concepts, information, or other materials (collectively, "Materials"), or by posting such Materials to any area of our web sites, you grant us and our designees a worldwide, non-exclusive, sublicensable (through multiple tiers), assignable, royalty-free, perpetual, irrevocable right to use, reproduce, distribute (through multiple tiers), create derivative works of, publicly perform, publicly display, digitally perform, make, have made, sell, offer for sale and import such Materials in any media now known or hereafter developed, for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the Materials. None of the Materials disclosed in any forum on our web sites shall be subject to any obligation, whether of confidentiality, attribution, or otherwise, on our part and we shall not be liable for any use or disclosure of any Materials.

Your Conduct on the DVDWishes.com Web Site

While using DVDWishes.com you agree not to:

• Restrict or inhibit any other visitor or member from using any DVDWishes Product, including, without limitation, by means of "hacking" or "cracking" or defacing any portion of any of Independent Media Group, LLC. (IMG) web sites;
• Use any DVDWishes Product for any unlawful purpose;
• Express or imply that any statements you make are endorsed by us, without our prior written consent;
• Transmit (a) any content or information that is unlawful, fraudulent, threatening, harrassing, abusive, libelous, defamatory, obscene or otherwise objectionable, or infringes on our or any third party's intellectual property or other rights; (b) any material, non-public information about companies without the authorization to do so; (c) any trade secret of any third party; or (d) any advertisements, solicitations, chain letters, pyramid schemes, investment opportunities, or other unsolicited commercial communication (except as otherwise expressly permitted by us);
• Engage in spamming or flooding;
• Transmit any software or other materials that contain any virus, worm, time bomb, Trojan, or other harmful or disruptive component;
• Modify, adapt, sublicense, translate, sell, reverse engineer, decompile or disassemble any portion of any of the DVDWishes Web sites;

• Harvest or collect information about visitors to or members of DVDWishes without their express consent; or
• Permit anyone without an account or subscription to use any IMG Product through your subscription, user name or password.

Right to Terminate
We reserve the right to terminate or restrict your use of our service, without notice, for any or no reason whatsoever.
